By engaging in a charter or utilizing our Service, you consent to these Terms. If you do not agree with any aspect of these terms, then you are prohibited from using the Service.

2. Service Overview

SilverGrovePark offers luxury yacht charter services that include, but are not restricted to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

Availability of services depends on scheduling and climate conditions. We hold the right to adjust or discontinue services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you are required to:

  • Be at least 18 years of age
  • Submit valid and complete data
  • Remit the necessary deposit as indicated in your reservation confirmation
  • Adhere to these Terms & Conditions

3.2 Confirmation

A booking is only secured following the payment received and our issued written confirmation. At our sole discretion, we have the authority to reject service to anyone.

3.3 Availability

Availability for charters is contingent on the vessel's schedule and favorable weather conditions. Efforts will be made to fulfill your requested dates and timings.

4. Payment Terms

4.1 Pricing

Prices are quoted in € and integrate taxes unless stated otherwise. Price changes may be enacted without immediate notification.

4.2 Payment Schedule

  • Deposit: 50% of total charter price necessary at the time of booking
  • Balance: Due 48 hours prior to the charter's start
  • Supplementary charges (if any): Due at the end of the charter

4.3 Payment Methods

We accept multiple forms of payment including major credit cards, bank transactions, and official cheques. Payments are processed using safeguarded, encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full refund minus processing fees
  • 24-72 hours before departure: 50% refund
  • Less than 24 hours before departure: No refund

5.2 Weather Cancellations

In the case that our captain deems weather conditions as hazardous, options provided include:

  • Schedule adjustment to an alternative date without extra charges
  • A full refund if rescheduling is unviable

5.3 Mechanical Issues

If mechanical issues arise with the assigned vessel, we will attempt to arrange a comparable alternative. Should an alternative not be available, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are expected to:

  • Obey all instructions from the crew
  • Utilize safety equipment when necessitated
  • Declare any health conditions affecting their safety
  • Stay within designated areas on the boat

6.2 Prohibited Items

On board, certain items are not allowed:

  • Glass containers
  • Illicit substances
  • Firearms or weaponry
  • Excess beverages (surpassing reasonable limits)
  • Animals (unless previously approved)

6.3 Conduct

Passengers should behave in a courteous and respectful manner. We reserve the right to end a charter prematurely with no refund if passenger behavior creates a safety threat or detracts from the enjoyment of others.

7. Liability and Insurance

7.1 Our Liability

Liability on our part is capped at the amount you paid for the charter. We are not accountable for:

  • Injuries resulting from passenger carelessness
  • Loss or damage to personal belongings
  • Indirect, consequent, or punitive damages
  • Delays due to weather or events out of our oversight

7.2 Insurance Coverage

Comprehensive marine insurance is maintained, encompassing our boats and operations. Passengers should maintain their own travel and personal insurance.

7.3 Assumption of Risk

By engaging in our charter services, you accept that boating activities come with inherent dangers and you take responsibility for your own security and health.

8. Modifications and Itinerary Changes

Itinerary, routes, or timetables are subject to alterations based on environmental circumstances, safety considerations, or operation needs. We promise to make an effort to supply similar alternative offerings.

9. Force Majeure

We are exempt from responsibility for delays, cancellations, or changes due to forces beyond our control, including but not limited to:

  • Severe meteorological events
  • Natural calamities
  • Regulatory mandates
  • Harbor restrictions
  • Mechanical disruptions

10. Privacy and Data Protection

Your private details are managed according to our Privacy Policy. Service usage signifies your agreement to the collection and usage of information as delineated in our Privacy Policy.

11. Intellectual Property

Web content including but not limited to text, imagery, logos, and graphics, is defended by copyright and trademark ordinances. Unauthorized reproduction, distribution, or derivations are prohibited without written consent from us.

12. Governing Law

The governing law for these Terms is in Montenegro jurisdiction. Disputes are to be handled in the courts based in Tivat, Montenegro.

13. Changes to Terms

Changes to these Terms can be enacted at any time, with updates published on our website displaying the new revision date. Continued usage of our services signifies acceptance of the new terms.
